Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DevSecOps Platform ("Platform", "Service") operated by Harshal Baviskar ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

The DevSecOps Platform is a cloud-based security tooling platform that provides:

• Static application security testing (SAST)
• Dynamic application security testing (DAST)
• Software composition analysis (SCA) and SBOM generation
• Vulnerability assessment and penetration testing (VAPT)
• Cloud security posture management (CSPM)
• Server and Kubernetes cluster monitoring
• AI-assisted remediation and compliance reporting

2. Account Registration

You must register for an account to use most features. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Be at least 18 years of age or have parental/guardian consent

3. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy. Scanning systems without proper authorization is strictly prohibited and may result in immediate account termination and legal action.

4. Subscription & Billing

• Free tier is available with feature limitations.
• Paid plans (Pro, Enterprise) are billed per user per month or annually.
• Early-adopter pricing applies to the first 100 organizations and is locked at that rate.
• Payments are processed via Razorpay (India) or Stripe (international) and are due in advance of each billing period.
• We may change pricing for new subscriptions at any time; existing subscriptions are unaffected until renewal.
• All prices exclude applicable taxes unless stated otherwise.
• Refunds are governed by our Refund & Cancellation Policy.

5. User Content & Data

You retain ownership of all code, scan results, configurations, and data you upload ("User Content"). By using the Service, you grant us a limited license to process User Content solely for the purpose of providing the Service to you.

Your data is handled per our Privacy Policy.

6. Intellectual Property

The Platform, including its software, design, trademarks, and content (other than User Content), is owned by us and protected by Indian and international copyright and trademark laws. You may not copy, modify, reverse-engineer, or redistribute any part of the Platform without our prior written permission.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance (announced in advance where possible)
• Suspend service for security, legal, or operational reasons
• Modify or discontinue features with reasonable notice

Enterprise plans include SLA commitments specified in the separate Order Form.

8. Termination

Either party may terminate this agreement:

• You may cancel your subscription anytime from the Billing page.
• We may suspend or terminate your account immediately for violations of these Terms, the AUP, unpaid invoices, or abuse.
• On termination, you may export your data for 30 days, after which it may be deleted.

9. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Automated security scanning has inherent limitations and is not a substitute for comprehensive manual penetration testing by qualified professionals.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability arising from or related to these Terms or the Service shall not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

11. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, losses, liabilities, and expenses (including attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms or the AUP, (c) your violation of any law or third-party right, or (d) unauthorized scanning or misuse of the Platform.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

13. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email to account owners at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
